Dive Deeper: The legislation directs the Federal Trade Commission (FTC) to establish a third‑party certification body to verify recyclable, compostable, and reusable claims on product packaging. The Commission may not issue any binding rule or regulation.
Why it Matters: Under the bill,packaging recycling claims must be qualified by informing consumers about the availability of recycling programs and collection sites where the product is sold. A package can be exempt if both of the following conditions are met:
A recycling program or facility is available to a substantial majority of consumers or communities in which the consumer product is sold (60%); and
The entire consumer product package, excluding any minor incidental component, is recyclable.
